This Acceptable Use Policy ("AUP") describes acceptable uses of the EasyPeasy Sales Service and forms part of our Terms of Service. By using the Service, you agree to comply with this AUP.
1. Permitted Use
You may use the Service for legitimate, lawful business purposes, including:
- Managing customer relationships, sales pipelines, and contact data
- Sending marketing and sales emails to recipients who have consented or where you have another lawful basis under the GDPR and PECR
- Generating sales documents, proposals, and coaching insights using the Service's AI features
- Conducting market research and competitive analysis using publicly available information
- Collaborating with team members on sales activities within your organisation
2. Prohibited Conduct
You must not use the Service to engage in any of the following:
2.1 Unlawful Activity
- Violating any applicable local, national, or international law or regulation
- Processing personal data without a lawful basis under the GDPR
- Engaging in fraud, money laundering, or other financial crime
- Facilitating terrorism, drug trafficking, or other serious criminal activity
2.2 Spam and Unlawful Communications
- Sending unsolicited marketing emails to individuals without their consent (violates PECR and the GDPR)
- Sending marketing emails to corporate recipients without a lawful basis or where they have opted out
- Disguising the origin of emails or using deceptive subject lines
- Including false or misleading header information in emails
- Using purchased or scraped email lists without verifying consent
- Sending emails that contain malicious links, phishing content, or malware
2.3 Data Privacy Violations
- Uploading personal data of individuals without a lawful basis for processing
- Processing special category data (health, religion, ethnicity, political opinions, etc.) through the Service
- Processing data of children (under 18) through the Service
- Failing to provide privacy notices to individuals whose data you process through the Service
- Ignoring data subject rights requests (access, erasure, objection) from individuals whose data you hold in the Service
2.4 Security and Integrity Violations
- Attempting to gain unauthorised access to the Service, other accounts, or computer systems
- Interfering with the proper functioning of the Service, including overloading, crashing, or disabling it
- Reverse engineering, decompiling, or disassembling any part of the Service
- Introducing viruses, trojans, worms, or other malicious code
- Using automated tools (bots, scrapers) to access the Service in a manner that exceeds normal usage patterns
- Sharing your account credentials or access tokens with unauthorised parties
2.5 Content Restrictions
- Storing or transmitting defamatory, obscene, or offensive content
- Storing or transmitting content that infringes the intellectual property rights of others
- Storing or transmitting content that promotes discrimination, hatred, or violence against any group
- Storing or transmitting content that depicts or promotes child exploitation
2.6 Misuse of AI Features
- Using AI features to generate deceptive, fraudulent, or misleading content
- Using AI features to impersonate another person or organisation
- Using AI features to generate content that infringes intellectual property rights
- Using AI features to create content that could cause harm, discrimination, or reputational damage
- Using AI features to process special category data
3. Email and Outreach Rules
When using the Service's email campaign and outreach features, you must comply with the following:
- Consent: Ensure you have valid consent or another lawful basis before sending marketing emails to individuals, as required by PECR and the GDPR.
- Opt-out mechanism: All marketing emails must include a clear, functioning unsubscribe link.
- Sender identity: Do not disguise or falsify your identity or the sender email address.
- Subject lines: Do not use misleading subject lines that misrepresent the email content.
- Honour opt-outs: Process unsubscribe requests promptly and within 2 business days.
- Data quality: Only email recipients whose data you have obtained lawfully.
- Frequency: Do not send excessive or harassing communications.
4. Contact Data Rules
When uploading or processing contact data in the Service, you must:
- Ensure you have a lawful basis for processing each contact's personal data (consent, legitimate interest, or contract)
- Conduct legitimate interest assessments where relying on legitimate interests
- Provide privacy notices to contacts where required by the GDPR
- Respond to data subject rights requests within one month
- Delete contact data when it is no longer needed or when requested by the data subject
- Not upload contact data obtained through unlawful means (e.g., stolen data lists)
5. Security Obligations
You are responsible for:
- Using strong passwords and keeping them confidential
- Managing user access within your account appropriately
- Notifying us promptly of any suspected or actual security breach
- Ensuring your users are trained on data protection and security best practices
- Using the Service in compliance with your own data protection obligations
6. Monitoring and Enforcement
- We may monitor use of the Service for compliance with this AUP, including automated monitoring of email campaigns and usage patterns.
- We reserve the right to investigate suspected violations and to take corrective action.
- We may suspend or terminate access immediately, without prior notice, for serious or repeated violations.
- We may report violations to law enforcement or regulatory authorities where we believe it is required or appropriate.
- We may remove or disable access to content that violates this AUP.
7. Consequences of Violation
Violations of this AUP may result in:
- Warnings and requests to cease the prohibited activity
- Temporary suspension of specific features or the entire account
- Permanent termination of your account
- Forfeiture of any fees paid (no refund, as per our Refund Policy)
- Reporting to relevant authorities
- Legal action where appropriate
8. Reporting Violations
If you become aware of any violation of this AUP, whether by your users or by others, please report it to abuse@easypeasysales.co.uk. Please include:
- A description of the violation
- The account or user involved (if known)
- Any supporting evidence
We will investigate all reports and take appropriate action. Reports may be made anonymously.
9. Changes to This Policy
We may update this AUP from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
